Before you begin setting up your account with TheMagicRetouch.com (herein referred to as “we”, “us”, or “TMR”), please read the following Terms & Conditions (“Terms & Conditions”) carefully. These Terms & Conditions govern your access to and use of the TMR service (“Service”). If you (“you”) agree to these Terms & Conditions, and wish to use the Service, please click on the “Sign Up” button. This will constitute a binding agreement between you and TMR. Your access to and use of the Service are expressly conditioned on your compliance with these Terms & Conditions. Note that any violation of these Terms & Conditions may result in termination of our Service to you.

Our Services

We TMR, provide photo retouching and editing services. According to the photo and requests submitted by you as customer. If the photo is successfully submitted and accepted by TMR, our designers will start working and deliver the new photo to the customer in the time agreed.

Your Submissions

You, as client will submit photographs to TMR, including without limitation, photo graphic images, as part of your use of the Service ( no other file is allowed to be uploaded ).

TMR will not use your Submissions for any purpose other than providing you with the service you request. Although TMR permanently evaluates its designers, may terminate their services for violating TMR policies.

If, at any time, you learn of any misdirection or misuse of your Submissions, please advise us, as we may correct or terminate the services of any designer responsible for such misdirection or misuse.

Under these Terms & Conditions, you agree that you will NOT post, place or transmit any of the following material or obtain any such material using the Service:

- Any threatening, defamatory, abusive, obscene, pornographic, inappropriate or profane material or any material that could give rise to any civil or criminal liability under applicable law;
- Any material sent from an anonymous or false address;
- Any material that could infringe rights of privacy, publicity, copyrights or other intellectual property rights without the permission of the owner of these rights and the persons (or their parents or legal guardians, where applicable) who are shown in the material if applicable;
- Any material that promotes bigotry, racism, hatred or harm against any individual or group;
- Any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.

User Security

Customer will be provided a personal password to access to their order status and images. We advise that you should keep it confidential and never reveal your password to anyone else. However, we can NOT guarantee password safety because it may be leaked out by our customers themselves.

Payment Method

Customers should offer payment at the time of placing their order. TMR belongs to Idiomas19 company Established in California since 2005, As a verified Paypal vendor since 2005, we accept secure and instant payment through Paypal. To protect the good standing procedures of Paypal we will release the retouched photographs right after the payment have been clear. Other Payment methods can be discussed personally.

Refund Police

In the event of client´s non satisfaction with our performance, we will revise the same photo for free, based on customer's initial and additional request, but there will be no refund in order to avoid abuse. In the event of late delivery, a full refund will be sent back to customer's account in Paypal.

Others

TMR reserves the right to terminate the access of any person/company to the system, with or without cause. TMR will report any unlawful use or abuse of its system to authorities and will prosecute unlawful conduct to the fullest extent of the law. TMR reserves the right to use all resources at its disposal, including but not limited to web logs, IP addresses, and particular customer identifying data, to detect, investigate, reports abuse of its system, reasonable suspicion of dangerous or unlawful conduct.
